The father of a three-month old girl fed a mixture of vodka and baby formula has been charged with murder in a crime he says was an accident.
One year after Keith Furlow's daughter died after consuming the mixture at his home just east of Atlanta, Georgia, he was indicted on felony murder and second-degree cruelty to children.
Court documents filed Thursday reveal the baby had a blood-alcohol level of .1119 after drinking the mixture from a baby bottle on June 8 of 2011.
She was rushed to Children's Healthcare of Atlanta where she was pronounced dead.
'Everything isn't always as it seems,' court appointed Defense Attorney Corinne Mull told CNN Friday. 'Accidents happen.'
'Obviously, at that age, a child isn't old enough to get up and go pick up a bottle herself,' District Attorney Robert James responded back to WSB.
'Children at four months old are fed whatever it is they consume,' he said.
Dr David Goo of CorrectMed Pediatrics said that even a small amount of alcohol in an infant's system can be fatal.
The effects are decreased breathing, low blood sugar levels and coma.
'It's tiny amounts that can cause significant danger to these infants,' he said.
