James Robert Scott, 30, has been jailed for 11 months for his second conviction for indecently touching a young girl. He was last jailed for nine months in 2008 for indecently assaulting a 10-year-old girl.
This time he denied sexual conduct with a girl aged 4 when he touched her after he was briefly left alone with her while visiting her house.
A Christchurch District Court jury found him guilty of touching the girl as she sat on his knee after Scott had an argument with a babysitter who then left the room.
Judge Paul Kellar said the young victim had "graphically demonstrated" what Scott had done when she gave her evidence in court.
Scott continues to deny the offending, which Judge Kellar said was a pity because it may make him ineligible for a sex offenders' treatment program such as STOP.
Scott will be released from prison straight away because he has been in custody for so long while on remand - time that counts towards his sentence.
Defence counsel David Stringer said Scott faced problems and tended to get involved in nuisance offending when his support in the community was withdrawn. He now had a girlfriend who remained supportive of him.
Judge Kellar noted that Scott suffered a brain injury when he was 15, and another in 2004.
The judge imposed the jail sentence with six months of release conditions, during which Scott will have to take treatment or counselling as directed by a Corrections Department psychologist. TOT News
